Tax Fraud and Tax Crimes

The most serious tax cases are not when the government is attempting to collect the tax owed, but when they are attempting to indict you for committing a tax crime in order to make an example out of you and deter others. Being charged with committing tax crime can be devastating and needs to be dealt with early if an indictment is to be avoided. 

One example of how the IRS investigates tax crimes is during a tax audit, where the examiner can assert a fraud penalty, which is equal to 75 percent of the portion which is attributable to fraud if they believe that fraud was committed. The examiner may also refer the matter to a fraud referral specialist who may recommend the case be forwarded to the Criminal Investigation Division of the IRS for further investigation.

After the investigation is concluded, the tax crimes that an individual could be charged with include: Tax Evasion, Filing a False Return, Conspiracy to Defraud the United States Government and other tax crimes.
